Class action instituted by Pierre Robillard against Écoservices Tria Inc., Gestion Tria Inc., the Attorney general of Quebec in right of the Ministry of sustainable development, environment and action against climate change and the city of La Prairie

Notice to class members

This notice is addressed to natural persons, including minors, residing or having resided in the “A” and “P” sectors of Candiac and in the sector known and designated as the “Faubourg du Golf” in La Prairie, on or after February 12, 2010, up to this date.

If you are one of these persons, you are automatically included as a member of the group in the class action without any further formality.

To opt out of the group, a member must notify the Clerk of the Superior Court by sending the form attached to this notice no later than the 60th day following the publication of this notice.

Class action summary

On November 15, 2016, a resident of Adelaide Street in Candiac, Mr. Pierre Robillard, was authorized by the Superior Court to institute a class action for and on behalf of the residents of the three sectors described above due to odors, dust and noise which he claims to have been emitted for years by the landfill and the sorting center of construction or demolition debris operated by Écoservices Tria inc. and Gestion Tria inc.

Mr. Robillard also sues the Ministry of Sustainable Development, Environment, and Action against Climate Change and the City of La Prairie, alleging their negligence to take all necessary measures to bring the nuisances to an end.

The class action was instituted on February 13, 2017.

The goals of the class action are as follows:

  • Obtain a Court order against the defendants requiring them to take all necessary measures for the alleged nuisance to cease;
  • Obtain a compensation of $5,000 per year for each group member since February 12, 2010, until judgment is rendered by the Court.

A member has the right to seek intervenor status in the class action.

No class member other than the representative plaintiff or an intervenor may be required to pay legal costs arising from the class action.
